A few clear terms.

Our agreement

These terms are between you and the operator of Tailwaggery, an Ohio-based service preparing to operate as Tailwaggery LLC. LLC formation is pending as of the effective date. By creating an account or making a purchase after being presented with these terms, you agree to them. You must be at least 18 and able to enter this agreement. If you do not agree, please do not create an account or purchase.

Our Privacy Policy explains information handling. Our Refunds & Delivery Policy forms part of the purchase terms. Nothing here removes consumer rights that cannot legally be excluded.

What we provide

You choose a scene, upload reference photos, and receive an AI-created, watermarked preview. AI interprets those references and may change details, proportions, expressions or anatomy. It does not recover a real moment, prove that an event occurred, or guarantee an exact likeness. Review the preview carefully before buying.

The current offer is a $9 USD digital portrait. Where offered by the selected scene, color and black-and-white finishes come from the same generated image. You receive the higher-resolution version of the selected preview without the Tailwaggery watermark. We do not promise professional manual retouching or unlimited generations.

The included retry is available once, before purchase, through the correction options shown in the studio. The free preview allowance and limits shown in your account apply; a purchase can unlock the next preview session. Fair-use and daily capacity limits may apply. Generation time is an estimate, not a guaranteed deadline. Products or packs marked “coming soon” are not yet available to buy.

Your account and reference photos

Keep your email and sign-in account secure and contact us if you suspect unauthorized access. Provide accurate information and use only your own account. You are responsible for photos you upload and must own them or have permission from the rights holder. A person appearing in a reference must have consented where required; for a child, obtain permission from their parent or legal guardian.

Do not upload unlawful material, intimate images without consent, child sexual abuse material, content that infringes another person’s rights, or material intended for harassment, deception, or impersonation. Do not bypass payment, remove preview watermarks to avoid purchasing, evade limits, scrape private content, interfere with the service, or attempt unauthorized access.

Ownership and permission to process

You keep any rights you have in your original photos. You grant us and our service providers a limited permission to host, copy, process, transform and deliver your uploads and generated portraits as needed to provide the service, maintain your account, address support requests, and meet legal obligations. This is not permission to publish your family in our advertising.

After payment, you may download, share and print your purchased portrait for personal use, including using a print provider of your choice. To the extent we hold transferable rights in that output, we grant you a perpetual, non-exclusive personal-use license. AI outputs may not be unique or eligible for copyright protection; we cannot promise exclusive rights or ownership of third-party material. Contact us about commercial uses.

Our brand, website design, template instructions, and example artwork remain subject to their respective owners’ rights. Permission to use your purchased portrait does not give you the right to copy or resell the service or its template catalog.

Prices, checkout and delivery

The price and any applicable tax or delivery adjustment will be displayed before payment. Prices are in USD unless checkout states otherwise. A purchase is a one-time payment, not a subscription. Stripe processes payments. Orders are confirmed after successful payment verification; a cancelled or unpaid checkout does not unlock a download.

Purchased portraits remain accessible in Your portraits while your account and the service remain available. Download a personal backup; we do not promise indefinite hosting. Digital access may be revoked after a full refund. See our refund and delivery details for problems with a purchase.

Physical products are currently available for browsing and delivery quotes only; ordering is not enabled. A quote does not place an order or reserve production capacity. Product and fulfillment terms will be shown before physical checkout becomes available.

Service availability and acceptable use

We may update scenes and features, pause generation during outages, or suspend an account where reasonably necessary to prevent abuse, enforce these terms, or comply with law. We will provide notice where appropriate and preserve applicable rights relating to purchases. You may stop using the service at any time and request account deletion through support.

Problems, warranties and responsibility

Contact us first if something goes wrong so we can try to resolve it. Subject to mandatory consumer protections and our express purchase promises, the service is provided as available, without a promise of uninterrupted access, perfect likeness, or fitness for every purpose.

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses, and our total liability for a claim arising from the service is limited to the greater of $100 USD or the amount you paid us in the preceding 12 months. These limits do not apply where prohibited by law, including liability that cannot legally be limited for fraud, intentional misconduct, or other non-excludable obligations.

Law, disputes and updates

Ohio law governs these terms, except where the mandatory law of your place of residence provides otherwise. This does not take away any non-waivable right to bring a claim in an appropriate court or use a consumer remedy. We do not require mandatory arbitration through these terms.

We may revise these terms for future use, update the date, and provide notice of material changes where required. Changes will not retroactively remove rights attached to an existing purchase without a lawful basis. If a provision is unenforceable, the remaining provisions continue to apply.
